Terms of Service
These Terms of Service ("Terms") govern your access to and use of the ToloCourt court-booking platform, websites, and applications (the "Service"), operated by Tolotech LLC ("Tolotech", "ToloCourt", "we", "us"). By creating an account, booking a court, or otherwise using the Service, you agree to these Terms.
Plain-language summary (not a substitute for the full terms): ToloCourt is software that lets clubs offer court booking and lets players reserve and pay for courts. Clubs set their own courts, prices, and policies. Payments are processed by Stripe. Be honest, don't abuse the Service, and understand that bookings and cancellations follow each club's posted rules.
1Who we are & what ToloCourt does
ToloCourt provides software that enables sports clubs ("Clubs") to publish court availability and accept reservations, memberships, and payments from their members and guests ("Players"). ToloCourt is a technology provider. We are not the operator of any Club, and we do not own, control, or supervise any court, facility, or session offered through the Service.
1aArtificial intelligence (AI) features
Parts of the Service use artificial intelligence to provide optional, assistive suggestions — for example, a setup assistant that proposes courts and pricing from a short description you provide. AI output may be inaccurate, incomplete, or unsuited to your circumstances. It is a starting point only: you are responsible for reviewing, editing, and approving any AI-generated suggestion before relying on it or publishing it, including any prices you charge. AI features do not provide professional, legal, financial, or tax advice. We do not warrant the accuracy or suitability of AI output, your use of these features is voluntary, and the Service is fully usable without them. AI features are powered in part by third-party providers and are also subject to our Privacy Policy.
2Eligibility & accounts
You must be at least 18 years old (or the age of majority where you live) to create an account. You are responsible for the accuracy of the information you provide and for all activity that occurs under your account. Keep your password confidential; notify us promptly of any unauthorized use. You may close your account at any time.
3Bookings, cancellations & club policies
Each Club sets its own courts, hours, pricing, guest fees, waivers, and cancellation and no-show policies. When you book, you agree to the policies the Club has posted for that booking. Cancellation windows, late-cancel fees, and no-show fees are determined and charged by the Club, not by ToloCourt. We provide the tools that apply those policies; disputes about a specific booking should be raised with the Club.
4Payments
Payments are processed by Stripe, our third-party payment processor, and are subject to Stripe's terms. ToloCourt does not store full card numbers. For Player payments, funds are collected on behalf of the Club and paid out to the Club. For Clubs, subscription fees for the ToloCourt platform are billed on a recurring basis as described at sign-up, including any free-trial period. You authorize us (and Stripe) to charge your selected payment method for amounts you incur. Except where required by law or a Club's policy, payments are non-refundable.
5Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or abusive purpose;
- interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service or its systems;
- scrape, copy, or resell the Service or its data without permission;
- misrepresent your identity or book courts you do not intend to use in order to deny access to others;
- upload content that is illegal, infringing, or harmful.
6Notifications
By providing an email address or phone number and opting in, you consent to receive transactional messages (such as booking confirmations, payment receipts, and reminders) by email and/or SMS. Message and data rates may apply to SMS. You can adjust your notification preferences in your account settings at any time.
7Intellectual property
The Service, including its software, design, and the ToloCourt name and marks, is owned by Tolotech and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service as intended. Content you submit remains yours; you grant us a license to host and display it as needed to operate the Service.
8Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. You participate in any sport or activity at your own risk; ToloCourt is not responsible for injuries, property loss, or the conduct of any Club, Player, or third party.
9Limitation of liability
To the fullest extent permitted by law, ToloCourt and Tolotech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid to ToloCourt in the three months before the claim, or (b) US $100.
10Indemnification
You agree to indemnify and hold harmless ToloCourt and Tolotech from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11Termination
We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that could harm us, other users, or third parties. You may stop using the Service at any time. Sections that by their nature should survive termination (such as payments owed, disclaimers, and limitations of liability) will survive.
12Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, unless applicable law requires otherwise.
